1. Acceptance of Terms

By inviting, adding, or using MegaBot ("the Bot", "we", "us", or "our") in your Discord server or interacting with it in any way, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately stop using the Bot and remove it from your server.

2. Description of Service

MegaBot is a Discord bot that provides various features including but not limited to:

• Virtual economy system with currency and items
• Gaming integration and LFG (Looking for Group) system
• Sports betting and tournament management
• AI-powered features using OpenAI's API
• Moderation and utility tools
• Study tools and resources
• Entertainment and fun commands
• Statistics and analytics

3. Eligibility

To use MegaBot, you must:

• Be at least 13 years old (Discord's minimum age requirement)
• Have a valid Discord account
• Comply with Discord's Terms of Service and Community Guidelines
• Have permission to add bots to the server (if applicable)
• Not be previously banned from using MegaBot

4. User Conduct and Prohibited Activities

4.1 Acceptable Use

You agree to use MegaBot in a lawful and respectful manner. You must NOT:

• Use the Bot for any illegal activities
• Abuse, exploit, or manipulate Bot features or systems
• Attempt to hack, DDoS, or compromise the Bot
• Spam commands or abuse rate limits
• Use the Bot to harass, bully, or harm others
• Generate inappropriate content using AI features
• Exploit bugs without reporting them
• Impersonate the Bot or its developers
• Use the Bot to violate Discord's Terms of Service

4.2 Economy System Rules

When using economy features:

• Currency and items have NO real-world value
• Account trading or selling is prohibited
• Exploiting glitches to gain currency is bannable
• Multi-accounting for economy advantage is not allowed
• Currency transfers cannot be disputed or refunded

4.3 AI Features Conduct

When using AI commands (/ask, /chat, /imagine):

• Do not generate illegal or harmful content
• Do not attempt to bypass content filters
• You are responsible for content you generate
• OpenAI's usage policies apply to all AI features
• Abusing AI features may result in permanent ban

5. Virtual Economy and Gambling

5.1 Virtual Currency

• All currency is virtual and has NO real-world value
• We do not sell currency for real money
• Currency cannot be exchanged for real money
• We reserve the right to reset or modify balances

5.2 Gambling Features

• All gambling is for entertainment with virtual currency only
• Users under 18 should check local laws regarding virtual gambling
• We are not responsible for "losses" in gambling games
• Gambling features may be disabled in your region if required by law

6. Intellectual Property

6.1 Bot Ownership

MegaBot, including all code, features, and documentation, is the intellectual property of its developers. You may not:

• Copy, modify, or reverse engineer the Bot
• Create derivative works based on the Bot
• Claim ownership of the Bot or its features
• Redistribute or sell the Bot's code

6.2 User Content

Content you create using the Bot (notes, AI generations, etc.) remains your property, but you grant us a license to store and display it as necessary for Bot functionality.

7. Data and Privacy

Your use of MegaBot is also governed by our Privacy Policy. By using the Bot, you consent to:

• Collection of user and server data as described in our Privacy Policy
• Storage of command history and interactions
• Use of third-party APIs (OpenAI, Discord, etc.)

8. Service Availability and Modifications

8.1 Availability

• We strive for 99% uptime but cannot guarantee uninterrupted service
• Maintenance may occur without prior notice
• Features may be temporarily unavailable
• We are not liable for service interruptions

8.2 Modifications

We reserve the right to:

• Add, modify, or remove features at any time
• Change command names or functionality
• Update these Terms of Service
• Discontinue the Bot entirely

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

MegaBot is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or reliability of information
• Fitness for a particular purpose
• Non-infringement
• Continuous or error-free operation

9.2 Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, currency, or items
• Server disruptions or bans caused by the Bot
• Content generated by AI features
• Actions taken by users using moderation features
• Any damages exceeding $0 (as the Bot is free)

9.3 Third-Party Services

We are not responsible for:

• Discord's service reliability or policies
• OpenAI's API availability or content
• Third-party websites linked from the Bot

10. Indemnification

You agree to indemnify and hold harmless MegaBot, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the Bot
• Content you generate using AI features
• Your violation of any laws or third-party rights

11. Termination

11.1 Termination by You

You may stop using the Bot at any time by:

• Removing the Bot from your server
• Requesting data deletion
• Simply not using Bot commands

11.2 Termination by Us

We reserve the right to terminate or suspend your access to the Bot at any time, with or without notice, for:

• Violation of these Terms
• Abusive or illegal behavior
• Any reason at our sole discretion

12. Dispute Resolution

12.1 Informal Resolution

Before taking formal action, please contact us through our support server to resolve any disputes informally.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms at any time. When we do:

• The "Last Updated" date will be revised
• Changes will be announced in our support server
• Continued use after changes constitutes acceptance
• Material changes will be highlighted

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and MegaBot regarding the use of the Bot.
